Terms of service

Agreement and eligibility

These terms govern your use of PrimePopup. By installing or using the app, you confirm that you can bind the Shopify merchant or business you represent and that your use complies with Shopify's applicable terms and policies.

The service

PrimePopup lets merchants configure storefront offers and review consent-aware performance signals. Features may evolve as the app is improved. You are responsible for reviewing offer content, trigger settings, discount eligibility, and the live storefront result before relying on them.

Current free access

PrimePopup is currently provided free of charge. If paid plans are introduced, we will provide notice and request approval through a Shopify-approved billing flow before charging you. We will not apply new fees retroactively.

Your responsibilities

You agree to:

  • Provide accurate, lawful offer copy, images, links, discounts, and timing information.
  • Obtain required consents and publish an appropriate store privacy policy and terms for your shoppers.
  • Keep your Shopify account secure and allow only authorized users to configure the app.
  • Avoid deceptive, infringing, malicious, discriminatory, or unlawful content and uses.
  • Maintain the required Shopify theme app embed and verify that your storefront theme supports the experience.

Content and intellectual property

You retain rights in content you provide. You grant us a limited license to host, process, and display that content only as needed to operate PrimePopup. We and our licensors retain rights in the app, its software, design, and documentation. These terms do not transfer ownership of either party's intellectual property.

Third-party services

PrimePopup depends on services supplied by Shopify, Vercel, and Supabase. Their outages, platform changes, policies, and terms can affect the app. We are not responsible for third-party services outside our control.

Availability and warranties

The service is provided on an "as is" and "as available" basis to the extent permitted by law. We do not guarantee continuous, error-free availability, a particular commercial outcome, or that every Shopify theme or third-party integration will remain compatible.

Limitation of liability

To the maximum extent permitted by law, PrimePopup will not be liable for indirect, incidental, special, consequential, or lost-profit damages arising from use of the service. For a claim relating to the current free service, our aggregate liability will not exceed USD 100. Nothing here excludes liability that cannot legally be excluded.

Suspension and termination

You may stop using the service by uninstalling it. We may suspend or terminate access for unlawful use, security risk, material breach, or discontinuation of the service. Terms that by their nature should survive termination—including intellectual-property, disclaimer, and liability provisions—will continue to apply.

Privacy and governing law

Our Privacy Policy explains how we handle information. These terms are governed by the applicable laws of India, without regard to conflict-of-law principles, except where mandatory local law provides otherwise.

Changes and contact

We may update these terms and will identify the current version by its effective date. Material changes will apply prospectively. Questions can be sent to support@primepopups.com.
